General Provisions
Section 69. Person and Deputies Authorized to Enforce this Code The Municipal Mayor, Municipal Agriculturist, CRM Officer, Municipal Planning and Development Coordinator, Municipal Treasurer, Municipal Local Government Operations Officer, Philippine National Police, Municipal FARMC, Municipal and Barangay Officials and Deputized Fish Wardens (Bantay Dagat) shall take lead in the implementation of this Code.
Section 70. Incentives to Bantay Dagat members or law enforcement officers All fines, or proceeds from law enforcement operation be it sale of confiscated catch or from administrative fines generated out of extra judicial settlements, shall accrue to the following: Forty percent (40%) to the Municipal Government; Twenty percent (20%) to the barangay where the apprehension was made and Forty percent (40%) to the Bantay Dagat members and law enforcement officers responsible in the apprehension of the violator, as incentives. The whole proceeds from the operation shall be turned over to the Municipal Treasurer as income of the Municipal Government and the incentives of the barangay and Bantay Dagat members and law enforcement officers shall be released to them following the COA rules and regulations.
Section 71. Obstruction to fishery law enforcement officer/Bantay Dagat members. The boat owner, master or operator or any person acting on his behalf of any fishing vessel who evades, obstructs or hinders any fishery law enforcement officer/Bantay Dagat members of the Municipal Government to perform his duty, shall each be fined two thousand pesos (P2, 000.00). In addition, the registration, permit and/or license of the vessel shall be cancelled.
Section 72. Penal Clause. Any individual or entity found violating any provision of this Code which do not have specific penalties shall be punishable for each offense by a fine of not less than Five Hundred Pesos (P500.00) but not more than Two Thousand Five Hundred Pesos (P2,500.00), or imprisonment of not more than six (6) months, or both, at the discretion of the proper court.
Section 73. Prosecution. Prosecution of offenses under this ordinance is without prejudice to the filing of the appropriate criminal case under Republic Act No. 8550 otherwise known as the “National Fishery Code”.
Section 74. Mandatory Review The Sangguniang Bayan shall undertake the mandatory review of this Code at least once every 3 years and as often as it may deem necessary, to ensure that coastal and fisheries policies and guidelines remain responsive to the changing circumstances.
