MUNICIPAL ORDINANCE NO. 05

AN ORDINANCE DECLARING THE PATRONAL FIESTA HELD EVERY SEPTEMBER 22 AS A MUNICIPAL FIESTA
BE IT ORDAINED by the Sangguniang Bayan of Miagao, Iloilo, that:
Section 1. TITLE. This ordinance shall be known as “An Ordinance Declaring the Patronal Fiesta Held Every September 22 as a Municipal Fiesta.”
Section 2. RATIONALE, PURPOSE AND INTENT OF THE ENACTMENT. The local government has traditionally undertaken various activities every September 22 to celebrate the town’s fiesta, a visible reflection of the town’s rich religious history which had for its fruit the construction of the Miagao Fortress Church, now considered among the few Heritage Landmarks in the world.
With the national government’s bullish promotion and development of the tourism industry, festivals sprouted like mushrooms all over the country. Such festivals were usually held in celebration of the local government unit’s founding anniversary.Hence, the municipality, in full cooperation with the national government program, held its Salakayan Festival during the municipality’s founding anniversary every February but the patronal fiesta remained to be observed and celebrated as a municipal fiesta by the people of Miagao, a clear indication that tradition and customs could never be downplayed or reduced by mere statutes.
Section 3. FUNDING. Funds shall be allocated annually by the municipality to defray the expenses for the conduct of various activities during the celebration.
Section 4. REPEALING CLAUSE. All ordinances, rules and regulations or parts thereof in conflict or inconsistent herewith are hereby repealed or modified accordingly.
Section 5. SEPARABILITY CLAUSE. If for any reason, any provision, section or any part of this ordinance is declared invalid by a court of competent jurisdiction or suspended or revoked by the Sangguniang Panlalawigan, such judgment shall not affect or impair the remaining provisions, sections or parts hereof which shall remain and continue to be in full force and effect.
Section 6. EFFECTIVITY CLAUSE -This ordinance shall take effect fifteen (15) days after its posting at the municipal hall and at least two (2) conspicuous places in the municipality.
ENACTED, this 20TH day of May 2010.
Section7. SEPARABILITY CLAUSE. In the event that any provision of this Ordinance is declared illegal, the validity of other provisions shall not be affected by such declarations which shall continueto be in full force and effect.
Section8. EFFECTIVITY.This Ordinance shall take effect upon approval.
