AN ORDINANCE DECLARING EVERY 3RD FRIDAY OF OCTOBER AS COOPERATIVE DAY IN THE MUNICIPALITY OF MIAGAO, AND PROVIDING FUNDS THEREFOR

Be it enacted by the Sangguniang Bayan in session assembled, that:

 

ARTICLE I

TITLE AND PURPOSE

 

Section 1. TITLE.This ordinance shall be known as “An Ordinance Declaring Every 3rd Friday of October as Cooperative Day of the Municipality of Miagao, and Providing Funds Therefor”.

 

Section 2. PURPOSES OF THE ENACTMENT.

 

1.To raise consciousness of the people to join the cooperative movement and uphold the principles and values of cooperativism.

 

2.To create public awareness about the sector’s modest contribution in the area of development.

 

3.To open opportunity in indoctrinating the value of unity and participation among stakeholders and discuss ways and means to further the growth and development of cooperatives.

 

4.To provide a venue of interaction and sharing of success stories with other cooperatives through the Principles of Cooperation among Cooperatives.

 

5.To provide a system for advocating policies in creating an environment conducive to the growth and development of cooperatives.

 

6.An venue to discover the potentials of cooperative members and officers as well as students particularly the intellectual capacity about the ideology of cooperativism, entrepreneurship, leadership, and other related fields in achieving effective and efficient operation and management of cooperatives as a business and social enterprises

 

7.To gather stakeholders and create a venue to renew their commitment and support through internalizing the ideology of cooperativism in achieving social change.

 

ARTICLE II

DEFINITION OF TERMS

AND LEGAL FRAMEWORK

 

Section 3. The following terms are conceptually and/or operationally defined as follows:

 

1.Cooperative – shall refer to the duly registered cooperative with the Cooperative Development Authority.

 

2.Code – shall refer to Republic Act No. 6939, otherwise known as the Philippine Cooperative Code of 2008.

 

3.Authority – shall refer to the Cooperative Development Authority.

 

4.LGU – shall refer to the Local Government Unit of Miagao

 

5.LGC – shall refer to Republic Act No. 7160, otherwise known as the Local Government Code of 1991.

 

6.Act – shall refer to Republic Act No. 9520, An Act Creating Cooperative Development Authority to promote the viability and growth to cooperatives.

 

7.Order – shall refer to Executive Order No. 95 known as “Implementing Rules and regulations on Cooperative promotion, Organization, Development and Supervision of the Local Government Unit “signed by President Fidel V. Ramos on June 8, 1993.

 

8.PD No. 493 – Presidential Proclamation dated October 27, 2003 and signed by President Gloria Macapagal Arroyo declaring the month of October 2004 and every year thereafter as Cooperative Month.

 

Section 4. Legal Framework:

 

1.Article 2 of the Code states that “It is the declared policy of the state to foster the creation and growth of cooperative as practical vehicle for promoting self-reliance and harnessing people power towards the attainment of economic development and social justice.

 

2.Article 2 of the Code mandates the government and shall its branches, subdivision, instrumentalities and agencies shall ensure the provision of technical guidance, financial assistance and other service to enable said cooperatives to develop into viable and responsive economic enterprises and thereby bring about a strong cooperative movement that is free from any condition that might infringe upon the autonomy or organizational integrity of cooperatives.

 

3.Section I paragraph 2 of the Act recognizes cooperatives as associations organized for the economic and social betterment of their members, operating business enterprises based on mutual aid and founded upon internationally accepted cooperative principles and practices. In furtherance of this policy, the appropriate national economic planning agency shall include the promotion and expansion of cooperatives as a major and indispensable component of national development plans.

 

4.Section 17 of LGC states that “the provisions and functions for the delivery of the services to the people have been transferred to the LGUs

 

5.Section 4 of the Order provides for the power and functions of the LGUs, through Local Chief Executive, in cooperate promotion, organization, regulation and development.

 

6.Section 3 (d) of the Act mandates the Authority to coordinate the efforts of the LGUs and private sector in the promotion, organization and development of cooperatives.

 

ARTICLE III

DECLARATION OF POLICY

 

Section 5. Third Friday of every year is hereby declared as Municipal Cooperative Day in the Municipality of Miagao, Province of Iloilo.

 

 

CHAPTER IV

MISCELLANEOUS PROVISION

 

Section 6.Funding. An amount as maybe necessary to implement the provisions and purposes of this ordinance is hereby appropriated from any available sources in the general fund of the municipality subject to the existing laws, rules and issuances.

 

CHAPTER V

FINAL PROVISIONS

 

Section 7.Separability Clause. If for any reason, any portion or provisions of this Code is declared unconstitutional or invalid, the other sections or provisions hereby which are not affected thereby shall continues to be in full force and effect.

 

Section 8.Applicability of other laws, rules and regulations. On matters not provided for in this Code, any existing applicable laws, corresponding implementing rules, regulations, and relevant issuances issued therefore shall apply in supplitory manner.

 

Section 9.Effectivity Clause. This Code shall take effect fifteen (15) days after its posting in at least three conspicuous places within the municipality and publication.
