AN ORDINANCE CREATING THE LEGISLATIVE BACKSTOPPING COMMITTEE

Be it ordained by the Sangguniang Bayan of Miagao, Iloilo that:

Section 1. TITLE – “This ordinance shall be known as “An Ordinance Creating the Legislative Backstopping Committee.”

Section 2. COMPOSITION – The Legislative Backstopping Committee shall be composed of the following:

1. Chairman : Vice Mayor
2. Co-chairman : Chairperson of the Committee on Rules of the Sanggunian
3. Vice-Chairman : Secretary to the Sangguniang Bayan
4. Members : One (1) Staff from the Office of the Secretary to the Sanggunian
: Three (3) Staffs from the Sangguniang Bayan Office
: Two (2) Technical Assistants from the Office of the Vice Mayor

Section 3. FUNCTIONS – The functions of the committee are as follows:

1. Set up a management information system for legislative action or decision.
2. Provide assistance in the preparation of the local legislative agenda.
3.  Conduct researches in aid of local legislation.
4. Act as liaison between local government executive departments and the Sanggunian.
5.  Take charge of the tracking and analysis of enacted ordinances and resolutions to:

a) Find out whether an approved ordinance or resolution is actually implemented or enforced through inquiry with the Municipal Mayor or department/office responsible for the implementation or enforcement of the same;

b) Determine whether the target sector of the population is aware of and familiar with the said ordinance or resolution through the use of field surveys or interviews with affected individuals chosen by random sampling;

c) Evaluate the effectiveness of an implemented or enforced ordinance or resolution through focus groups; and,

d) Make reports to the Sanggunian of both negative and positive feedbacks.

Section 4. FUNDING – Funds shall be allocated annually by the municipality to defray the Committee’s operating expenses.

Section 5. SEPARABILITY CLAUSE – If for any reason, any provision, section or any part of this ordinance is declared invalid by a court of competent jurisdiction or suspended or revoked by the Sangguniang Panlalawigan, such judgment shall not affect or impair the remaining provisions, sections or parts hereof which shall remain and continue to be in full force and effect.

Section 6. EFFECTIVITY CLAUSE – This ordinance shall take effect fifteen (15) days after its posting at the municipal hall and at least two (2) conspicuous places in the municipality.
