EXECUTIVE ORDER NO. 08-A
Series of 2013
AN EXECUTIVE ORDER REORGANIZING THE MIAGAO LOCAL HEALTH BOARD, PRESCRIBING ITS FUNCTIONS AND SCHEDULE OF MEETINGS
WHEREAS, every Local Government Unit (LGU) shall exercise the powers , those necessarily implied there from, as well as powers necessary, appropriate and those which are essential to the promotion of the general welfare; and
WHEREAS, Title V, Section 102 to 105 of the Local Government Code of 1991 allows the LGU to create the Local Health Board to cater to the well-being and promote health safety for its inhabitants;
NOW THEREFORE, I, Macario N. Napulan, Municipal Mayor of the Municipality of Miagao, Iloilo, Philippines, by virtue of the power vested in me by law as the Local Chief Executive, I hereby reorganize the Miagao Local Health Board, prescribing its functions and schedule of meetings.

Section II. Functions
- Propose to the Sangguninang Bayan, in accordance with the standards and criteria set by the department of Health (DOH), the annual budgetary allocations for the operation and maintenance of health facilities and services within the municipality;
- Serve as an advisory committee to the Sangguniang Bayan on health matters such as, but not limited to, the necessity for, and application of local appropriations for public health purposes;
- Create committee and/or technical working groups (TWGs) which shall advise local health agencies on matters such as, but not limited to, technical and administrative standards of DOH, personnel selection and promotion, bids and awards, grievance and complaints, personnel discipline, budget review, operations review and similar functions; and
- Shall be primarily responsible for the screening of Barangay Health Workers (BHWs) in the Municipality of Miagao prior to their registration and accreditation as stated in Section 4 of R.A. 7883 otherwise known as “The Barangay Health Workers Benefits an Incentives Act of 1995 or the BHW Law.”
Section III. Meetings and Quorum
- The Board shall meet at least once a month;
- A majority of the members of the Board shall constitute a quorum, but the chairperson or the vice-chairperson must be present during the meetings where budgetary proposals are being prepared or considered. The affirmative vote of a majority of the members shall be necessary to approve such proposal;
- In the absence of the chairperson and vice-chairperson, any member may preside the eating as authorized by the majority of the Board members present;
Section IV. Compensation and Remuneration
The chairman, vice chairman, and members of the Municipal Health Board shall perform their duties as such without compensation or remuneration. Members thereof who are not government officials or employees shall be entitled to necessary travelling expenses and allowances chargeable against the funds of the Local health Board concerned, subject to the existing accounting and auditing rules and regulations.
Section V. Direct Supervision and Control of DOH over Local Health Operations
In case of epidemics, pestilence, and other widespread public health dangers, the Secretary of Health may, upon the direction of the President in consultation with the LGU, temporarily assumes direct supervision and control over health operations in any LGU for the ducation of the emergency, but in no case exceeding a cumulative period of six (6) months. With the concurrence of the LGU concerned, the period for such direct national control and supervision may be further extended.
FURTHERMORE, let copies of this Executive Order be furnished to all concerned for their information and guidance.

EXECUTIVE ORDER REORGANIZING THE MUNICIPAL FINANCE COMMITTEE
WHEREAS, Republic Act No. 7160 provides among others the Creation of the Finance Committee in every Local Government Units;
WHEREAS, the Local Finance Committee is primarily tasks to determine the projected annual income and recommend to the Local Chief Executive the level of annual expenditures and other matters concerning the municipal budget;
WHEREAS, with the advent of the new administration, there is a need to reorganize the composition of the Municipal Finance Committee,
WHEREFORE, by the power vested upon me as the Local Chief Executive, I hereby order the reorganization of the Municipal Finance Committee according to the provisions of Article 412 of the RA 7160, viz;

The members of the committee shall initially meet on July 18, 2013 at 2:00 P.M. at the Office of the undersigned to discuss matters relative to the Annual Investment Program and the Annual Budget for CY 2014.

EXECUTIVE ORDER NO. 2013-01-A
RE-ORGANIZATION OF THE BIDS AND AWARDS COMMITTEE (BAC), FUNCTION AND MEMBERSHIP THEREOF PURSUANT TO REPUBLIC ACT NO. 9184
WHEREAS, Republic Act No. 9184, otherwise known as the “Government Procurement Reform Act”, provides the creation of the Bids and Awards Committee (BAC) in every procurement entity for its procurement with one (1) year term:
WHEREAS, we find it imperative to reorganize the Bids and Awards Committee (BAC) to ensure that the standards set forth the said Act shall be properly observed;
NOW, THEREFORE, I, MACARIO N. NAPULAN, Municipal Mayor of Miagao, Iloilo by virtue of the powers vested in me by law, do hereby re-organize the Bids and Awards Committee (BAC), with the following functions:
1. Advertise and/or post the invitation to bid;
2. Conduct pre-procurement and pre-bid conferences;
3. Determine the eligibility of prospective bidders;
4. Receive Bids;
5. Conduct the evaluation of bids;
6. Undertake post-qualification proceedings;
7. Resolve motions for reconsiderations;
8. Recommend award of contract to the head of the procuring entity or his duly authorized representative;
9. Recommend the imposition of sanctions in accordance with Rule XXIII;
10. Perform such other related functions as may be necessary, including the creation of a Technical Working Group (TWG); and
11. Recommend to the head of the procuring entity the use of Alternative Methods of Procurement as provided for in Rule XVI.
The following shall compose the Municipal Bids and Awards Committee:

In accordance with Rule V, Section 11, subparagraph 11.2.3 of R.A. 9184, the Municipal Bids and Awards Committee shall convene and elect among themselves who shall act as the Chairman and Vice Chairman.
Pursuant to Section 13 of Article V of R.A. 9184, the following observers are hereby identified:

Further, the following personnel are hereby designated as BAC Secretariat:

The Secretariat shall have the following functions and responsibilities:
1. Provide administrative support to the BAC;
2. Organize and make all necessary arrangements for the BAC meetings;
3. Attend BAC meetings as Secretary;
4. Prepare minutes of the BAC meetings;
5. Take custody of procurement documents and be responsible for the sale and distribution of bidding documents to interested bidders;
6. Assist in managing the procurement processes;
7. Monitor procurement activities and milestones for proper reporting to relevant agencies when required;
8. Consolidate Project Procurement management Plans (PPMPs) from various units of the procuring entity to make them available for review as indicated in Section 7 of the IRR of this Act;
9. Make arrangements for the pre-procurement and pre-bid conferences and bid openings; and
10. Be the central channel of communications for the BAC with end users, PNOs, other units of the line agency, other government agencies, providers of goods, civil works and consulting services, and the general public.
This Executive Order repeals/ revokes previous issuances inconsistent hereof.
